“Electronic Signature Suffices And Binds As Signature In Nigeria”
Where a rule of evidence requires a signature, or provides for certain consequences if a document is not signed, an electronic evidence satisfies that rule of law or avoids those consequences.
Electronic signature is legally binding on the signatory.
Electronic signature may be executed in form of symbol or security procedure which verifies that an electronic record is that of the person.
The term “electronic signature” means an electronic sound, symbol, or process, attached to or logically associated with a contract or other record and executed or adopted by a person with the intent to sign the record.
Legal Authority: Section 93(2) and (3) of the Evidence Act, 2011. And also, U.S Electronic Signatures in Global and National Act.
