“Infringement of your registered Trademark, Copyright, Patent or Design can be redressed at the Federal High Court in Nigeria”.
A person who owns a registered trademark, copyright, patent or design has industrial, commercial and legal monopoly over the trademark, copyright, patent or design.
Infringement, breach or violation of the trademark, copyright, patent or design can be redressed and remedied at the Federal High Court because the Federal High Court has jurisdiction over matters arising from trademark, copyright, patent or design.
Legal Authority: Section 251(1)(f) of 1999 Constitution of the Federal Republic of Nigeria (as amended).
Legal Advice: Trademark, copyright, patent and design protect your products, services, authorship, invention, designs or other works from industrial and commercial use and infringement by another person.
Secondly, the owner of trademark, copyright, patent or design can commence legal action against another person in tort at the State High Court, depending on the circumstances of the case. See, Society Bic S.A v. C.1 Ltd (2014) All FWLR (Pt. 739) page 1212 @ page 1239, paras. B-C.
