LEGAL SENSE (Hint 24)
by ANSLAM C. AGIM, ESQ
A Will is a testamentary and revocable document voluntarily made, executed and witnessed according to law by a testator with sound disposing mind wherein he disposes of his property subject to any limitation imposed by law and wherein he gives such other directives as he may deem fit to his personal representative otherwise known as his executors who administer his estate in accordance to the wishes manifested in the will. See, Law of Wills in Nigeria, Edited by Prof. A. A. Utuama, Mr. G. M. Ibru, published by Shaneson C. I. Limited, pages 8 to 9.
Any adult of sound mind can make a Will and any personally owned property can be willed.
Making of Will does not cause death of the testator, rather Will makes the testator to speak forever.
